Evidence of Liability

This page contains evidence of the dangerous conditions posed by unregulated, experimental, discriminatory, non-uniform luminance and toxic LED lights and LED flashing lights as well as fraudulent or unsupported statements made by the purveyors of LED lights.

LEDs are Safe – Fact or Fiction? – 2005 -This article describes how the LED lighting industry bullied the standards groups into removing LEDs from the classification of laser in order to sell billions of LEDs.

Radiance of the sun, a 1 mW laser pointer and a phosphor emitter – 2013 – This scientifically dense article claims that stars and lasers are “point sources”, but that LEDs are not. The article discusses how field of view must be used when measuring non-homogenous sources. We agree with the content of this article, but the LED lighting industry has ignored the science discussed here.

Illuminating Engineering Society

The IES purports to be a non-profit, but in practice, the IES is a front for the lighting industry. Companies such as Signify and Acuity Brands pay tends of thousands of dollars to support IES.

IES claims that LEDs are “point sources” of light. This is a false statement, as LEDs are “Lambertian sources”. The IES falsely claims, “LED luminaires employ a number of small point sources of light.”

IES RP-8-18

Because of the false assertion that LEDs are point sources, the entire IES RP-8-18 Roadway Lighting standard is invalid for LED lights sources.

International Dark Sky Association

The IDA has now states that 2200K should be used for outdoor lighting. This is an improvement. However, the IDA only lists 2200K on one of their web pages. All the other pages say use 3000K or less. The reason for this is that the Dark Sky Fixture Seal of Approval program was configured for “3000K or less” and the IDA doesn’t want to upset the lighting industry.

National Highway Transportation Administration

NHTSA claims that LED headlights, even at 200,000,000 nits comply with FMVSS-108. We believe that this is not possible. FMVSS-108 was written for uniform luminance emitters, not directed-beam emitters such as LED.

Oregon

Douglas County – July 24, 2021 – Sheriff Vehicle – The video and photo show this Douglas County Sheriff’s vehicle using the emergency lights simultaneously with brake lights. The use of the upper lighting causes drivers to believe that an emergency action is taking place. In addition, the lights appear to flicker (the left photo shows the lights on, the right photo shows the lights off), leading to possible neurological reactions such as epileptic seizures, debilitating migraines and loss of emotional control.
